    Termite Baiting System Repair and Retreat

    SERVICE COVERAGE- Future Services, Inc. will provide the necessary services to the described property above to control or protect against subterranean termites (Reticulitermes spp.,Heterotermes spp.) and Formosan termites (Coptotermes). Our program DOES NOT cover above ground aerial infestations of any kind such as Drywood termites, or other wood destroying insects such as carpenter ants, powder post beetles, wood destroying fungi, etc.

    INSTALLATION PROCESS- 1. Future will Install the Termite Baiting System around the perimeter of the structure specified. 2. Monitor and inspect baited and un-baited stations according to the manufacturer’s specifications. 3. Add termite bait and pre-bait to and remove it from stations as appropriate. 4. Provide station reports following every service visit. 5.Twelve (12) months from the date of initial installation, Future will provide for repairs of new termite damage as set forth in the agreement. HOWEVER, THE FULL DAMAGE REPAIR GUARANTEE IS EFFECTIVE UPON INSTALLATION OF THE BAIT SYSTEM ON STRUCTURES WHICH HAVE NO PRESENT OR PAST TERMITE ACTIVITY INCLUDING THE INSTALLATION ON NEWLY CONSTRUCTED STRUCTURES.

    Renewable Protection
    RENEWABLE PROTECTION-The initial treatment shall be guaranteed for a period of one year from the date the property is first treated or, in the case of new construction, one year from the date of closing. The guarantee may be renewed annually provided that the company has an opportunity to re-inspect the treated property on an annual basis and payment of the Annual Renewal Fee is made on or before the expiration of the annual guarantee period for as long as purchaser may own the property FUTURE reserves the right to revise renewal charge after the 3rd year. In the event the property is sold, FUTURE, agrees to transfer Guarantee to the new Owner upon payment of a $75 transfer fee. In the event the new Owner fails to request transfer in writing within 30days of change of ownership and pay transfer fee, the Guarantee will terminate automatically the date of ownership change.

    THIS GUARANTEE PROVIDES FOR FUTURE DAMAGE PROTECTION AGAINST THE SPECIFIED TERMITES UP TO AND SHALL NOT EXCEED TWO HUNDRED & FIFTY THOUSAND DOLLARS ($250,000) AGGREGATE LOSS. ANY AND ALL CLAIMS ARE SUBJECT TO A $250.00 DEDUCTIBLE. SEE CONTRACT DETAILS ON BACK OF THIS CONTRACT. TERMITE REPAIR WORK MUST BE PERFORMED BY AGENT OF COMPANY INSURANCE.

    Electronic Statements
    In accordance with state regulations, pest control companies have a responsibility to provide you with a record every time a pesticide product and/or pest system is applied. This record is required to be provided to the property owner, resident or custodian of the property. This record may include post-application precautionary information.     *Payment Details*
    The initial payment is due today. Customer agrees that the initial payment method used today will be processed the business day after each service going forward. Customer also agrees that checks may be converted to ACH bank account draft after service is completed. This authorization will continue until revoke in writing.

    Terms And Conditions – TBS-RR

    REPAIR GUARANTEED PROTECTION This guarantee provides protection against the subterranean termites specified above. Future’s guarantee provides for re-treatment and repair protection against NEW DAMAGE to the structure and its contents. The company warrants that should (1) any new and/or additional wood damage to the permanently affixed portions of wood in the building(s) due to subterranean termites and/or (2) any active re-infestation in the visible areas of the building(s) by subterranean termites NOT disclosed on the attached graph and be discovered and reported to the company in WRITING within Thirty (30) days of discovery and be during the term of this agreement, the company will repair such damage and will retreat the reinfestation; provided, however, the company’s liability shall not exceed TWO HUNDRED AND FIFTY THOUSAND DOLLARS ($250,000).•THIS WARRANTY IS SUBJECT TO THE CONDITIONS ABOVE AND ON THE REVERSE SIDE OF THIS AGREEMENT. Unless live termites are found in the damaged area the dam-age will be considered to be old and will not be covered. THIS CONTRACT SHALL BE EFFECTIVE FOR A PERIOD OF (1) ONE YEAR FROM THE AGREEMENT DATE. THERE-AFTER THIS CONTRACT SHALL RENEW ITSELF FROM SERVICE TO SERVICE UNTIL TERMINATED BY EITHER PARTY. IF CANCELED BEFORE THE 1ST YEAR IS COMPLETED,CUSTOMER WILL BE RESPONSIBLE FOR THE CONTRACT BALANCE. If service is discontinued a written notice must be given by either party 30 days prior to next scheduled service. FUTURE will make such repairs as necessary to correct new damage, provided:1.Damage was caused by the specified termites and occurred during the term of this contract and…2.FUTURE finds the damaged area(s) infested with live subterranean termites. Unless live subterranean termites are found in the damaged area(s), the damage will be considered to be OLD damage & will NOT be covered. NEW & OLD Termite Damage is covered on structures treated at NEW CONSTRUCTION. 3.FUTURE personnel verifies the evidence before it is altered or destroyed.4.All repair work will be performed or supervised by FUTURE AUTHORIZED personnel only, unless otherwise agreed upon in writing. Any non-authorized repairs will not be covered or reimbursed by FUTURE under any circumstances.5.Monitoring / Baiting devices have not been, removed, or otherwise tampered with so as to compromise the integrity of the monitoring / baiting program.THIS GUARANTEE PROVIDES FOR FUTURE DAMAGE PROTECTION AGAINST THE SPECIFIED TERMITES UP TO AND SHALL NOT EXCEED TWO-HUNDRED AND FIFTY THOUSAND DOLLARS ($250,000) AGGREGATE LOSS PER RESIDENCE. ANY AND ALL CLAIMS ARE SUBJECT TO A $250.00DEDUCTIBLE. FUTURE SERVICES WILL INSPECT THE PROPERTY ANNUALLY. FAILURE TO GIVE FUTURE SERVICES INSIDE ACCESS TO THE BUILDING MAY RESULT IN DENIAL OR PARTIAL DENIAL OF THE CLAIM. EXISTING DAMAGE. FUTURE is not responsible for the repair of either visible dam-age or hidden damage existing as of the date of this Agreement.. Because damage maybe present in ares which are inaccessible to visual inspection, FUTURE does not guarantee that the damage disclosed on the Inspection Graph represents all of the existing damage as of the date of this Agreement.WATER LEAKAGE. Water leakage in treated areas, and leakage in interior areas or through the roof or exterior walls of the identified structure, may destroy the effective-ness of FUTURE’S treatment, and is conducive to new infestation. The Owner is responsible for making timely repairs as are necessary to stop leakage. If Owner elects not to repair said defects , then FUTURE shall have no further obligation under thisAgreement.ADDITION, ALTERATIONS. This Agreement covers the structures described on theInspection Graph as of the date of the installation of the Baiting System. In the event the premises are structurally modified, altered or otherwise changed or if soil is removed or added around the foundation, or if FUTURE’S baiting stations are disturbed. Purchaser will notify FUTURE prior to such event and will purchase addition-al treatment required by the changes incurred. Failure to do so will terminate thisAgreement automatically without further notice. In the event of any such change, FUTURE reserves the right to adjust the renewal fees. The failure of FUTURE to notice any such changes does not release Purchaser from the obligations set forth in this para-graph.NOTICE OF CLAIMS, ACCESS TO PROPERTY. Any claim under the terms of thisAgreement will be make immediately in writing to any FUTURE office. FUTURE is only obligated to perform under this Agreement provided the Owner allows FUTURE access to the identified structure for any purpose contemplated by this Agreement, including but not limited to re-inspection, whether the inspection was requested by theOwner or considered necessary byFUTURE..DISCLAIMER. liability under this Agreement will be terminated if FUTURE is prevented from fulfilling its responsibilities under the terms of this agreement by reason of delays in transportation, shortages of fuels and/or materials, strikes, embargoes, fires, floods, quarantine restrictions, and/or any act of God or circumstances or cause beyond the control ofFUTURE. Should the Termite Bait used in the station be discontinued or unavailable to FUTURE in the future, the system shall con-vert to a monitoring system only. Termite control will be achieved by some other form of conventional treatment.OWNERSHIP OF THE FUTURE TERMITE BAITING SYSTEM. All of the components of the system are and will remain the property of the company. The customer has no right to any of the components, other than the rights to their use an indicated by the company on the customer’s premises under this agreement. On expiration or termination of this agreement, the company or its representatives are authorized by the customer to retrieve from the customer’s premised, the components contained therein for appropriate disposition.CHANGES IN LAW. FUTURE performs its services in accordance with the requirements of law. In the event of a change in existing law as it pertains to the services herein, FUTURE reserves the right to revise the renewal fees or terminate this agreement.NON-PAYMENT DEFAULT. In case of non-payment or default by the Purchaser, FUTURE has the right to terminate this agreement. In addition, cost of collection shall be paid by the Purchaser, whether suit is filed or not. In addition, interest at the highest legal rate will be assessed for the period of delinquency.EXCLUSIONS. This Agreement does NOT cover and FUTURE will NOT be responsible for:1.Damage to wood flooring that is installed directly or indirectly on and in contact with a concrete slab or foundation.2.Damage resulting from moisture conditions, including but not limited to fungus, whether visible or not.3.Damage resulting from wood in direct contact with the soil, whether visible or not.4.Damage resulting from stucco on wire lathe on frame and/or rigid foam board and/or expanded foam materials in contact with the soil or covering interior or exterior foundation walls in such a way as to provide termites with hidden or protected access to the structure whether visible or not.5.Damage resulting from masonry failure or grade alteration(s).6. into the structure after initial treatment.EXCEPT AS OTHERWISE PROHIBITED BY LAW, FUTURE DISCLAIMS AND SHALL NOT BE RESPONSIBLE FOR ANY LIABILITY FOR INDIRECT, SPECIAL,INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, STIGMA AND/ORLOSS OF ENJOYMENT DAMAGES. THE OBLIGATIONS OF FUTURE SPECIFICALLY STATED IN THIS AGREEMENT ARE GIVEN IN LIEU OF ANY OTHER OBLIGATIONS OR RESPONSIBILITY, EXPRESS OR IMPLIED, INCLUDING ANY REPRESENTATION OF MERCHANTABILITY OR FITNESS FOR A PARTIC-ULAR PURPOSE.ENTIRE AGREEMENT.This Termite Plan, these Terms and Conditions and theInspection Graph constitute the entire Agreement between the parties and no other representations or statements will be binding upon the parties. Agreement may not be changed or altered in any manner, oral or otherwise, unless such alteration or change be in writing and executed by the President ofFUTURE SERVICES, INC.ARBITRATION. The Parties agree that any claim or dispute between them or againstany agent, employee, successor, or assign of the other, whether related to this agreement or otherwise, and any claim or dispute related to this agreement or the relation-ship or duties contemplated under this contract, including the validity of this arbitration clause, shall be resolved by binding arbitration by the American ArbitrationAssociation (or name other firm providing arbitration services, i.e., NationalArbitration Forum), under the Arbitration Rules then in effect. Any award of the arbitrator(s) may be entered as a judgment in any court of competent jurisdiction.Information may be obtained and claims may be filed at any office of the AmericanArbitration Association or at Corporate Headquarters, 335 Madison Avenue, Floor 10,New York, New York 10017-4605. If FUTURE is unable to solve your pest problems, we will refund your INITIAL TREATMENT fee, provided:1. Your request is made toFUTURE, in writing, within 15 days following the initial treatment, and2. After receiving your written request, FUTURE is unable to remedy the PEST PROBLEMS within 90 days..In the event of a refund FUTURE SERVICES will refund the INITIAL SERVICE fee, less a 35% restocking fee.     Notice To Buyer
    NOTICE TO BUYER You, the Buyer, may cancel this agreement within 3 business days of the date of this transaction by giving written notice of cancellation by registered mail to FUTURE SERVES, INC. I hereby waive the three (3) day period for cancellation so that FUTURE may perform the service checked above.

    THE GEORGIA STRUCTURAL PEST CONTROL ACT REQUIRES ALL PEST CONTROL COMPANIES TO MAINTAIN INSURANCE COVERAGE. INFORMATION ABOUT THIS COVERAGE IS AVAILABLE FROM THIS PEST CONTROL COMPANY.
